Addressing the Council: No person shall address the Council during a Council Meeting, unless they have notified the City Clerk by 5:00 P.M. on the day of any Council Meeting of their desire to speak on a specific matter on the published meeting agenda or during the public comment portion of the Council Meeting. This limitation shall not apply to items added during the course of a meeting. The Council does not take action with respect to any subject not on the agenda unless added to the agenda by a two-thirds vote of the Council
Persons addressing the City Council will be limited to four (4) minutes of public address on a particular agenda item. Debate, question/answer dialogue or discussion between Councilmembers will not be counted towards the four (4) minute time limitation. The Chair may extend time with the unanimous consent of the Council or the Council by affirmative vote of five (5) members may extend the four (4) minute limitation.
Persons will be limited to addressing the City Council one (1) time on a particular matter unless otherwise allowed by an affirmative vote of five (5) members of the City Council.
Citizens wishing to offer Public Comment may sign up by phoning the City Clerk’s office at 368-3940.
To make arrangements for special accomodations please call 785-368-3940. A 48-hour advance notice is preferred.
The Federal Communications Commission (FCC) has adopted use of the 711 dialing code for access to Telecommunications Relay Services (TRS). TRS permits persons with a hearing or speech disability to use the telephone system via a text telephone (TTY) or other device to call persons with or without such disabilities. (Approval would grant a noise exception for an event on October 8, 2009 from 3:00 p.m. to 5:00 p.m. at Betty Phillips Park.)

AN ORDINANCE introduced by Councilmember Deborah Swank authorizing the sale, consumption and possession of alcoholic liquor as part of the ARTSConnect Arty Party at specified locations and times.  Final Reading.

(Approval would allow state-licensed vendors to sell alcoholic beverages in a barricaded portion of SW 16th Street during the event.)

AN ORDINANCE introduced by Councilmember Deborah Swank, amending City of Topeka Code Sections 78-226 through 78-239 concerning clean indoor air in public places and places of employment and repealing said original sections and creating Sections 78-240 through 78-242.  Final Reading.  (Deferred from the meeting of August 25, 2009.)

(With limited exceptions, approval would prohibit smoking in public places and places of employment.)

  A. Resolution - Burlington Northern Santa Fe Railroad Crossing Repairs

A RESOLUTION introduced by Councilmembers Sylvia Ortiz and John Alcala requesting Burlington Northern Santa Fe Railroad to expedite its repairs of the railroad crossing located on SE 4th Street.  (Council District No. 3)

(The intersection of SE 4th Street between SE Adams and SE Hancock Streets maintained by Burlington Northern Santa Fe Railroad has been in a state of deterioration for a number of years, creating a driving hazard to motorists and causing damage to vehicles.)

  A. Ordinance - General Obligation Bonds, Series 2009-A and 2009-B

AN ORDINANCE introduced by City Manager Norton N. Bonaparte, Jr., authorizing the issuance of $3,390,000 aggregate principal amount of General Obligation Improvement Bonds, Series 2009-A,  and $58,020,000 aggregate principal amount of General Obligation Refunding Bonds, Series 2009-B of the City of Topeka, Kansas, under the authority of K.S.A. 10-101 to 125, inclusive, K.S.A. 10-427 et seq., K.S.A. 12-6a01 et seq., the home rule authority granted to the cities of the State of Kansas by Section 5 of Article 12 of the Kansas Constitution, and Charter Ordinance No. 89 of the city, all as amended.  First Reading.

Voting Requirement:  Majority vote of the Governing Body, including the Mayor.

(Approval would authorize the issuance of general obligation bonds.  The proceeds would pay for a number of public infrastructure improvements that have already been approved by the Council that are completed or under construction and refund existing debt.)
